As of March 23, 1999, the Thai authorities have established new criteria for rights to acquire land from a Thai spouse, married (e) or cohabiting with an alien or a foreign as follows:

1 – Case of a Thai national married (e) legally with a (an) international (e)

If he wishes to buy land or receive title to a third party to convey to this Thai national during his marital status, are now allowed, provided that after investigation the authorities, both spouses make a Joint written statement as what the money the Thai national reserve for the purchase of the land comes in whole and exclusively his own personal funds and not part of the joint property of the couple.

If the foreign spouse would not ratify such written statement or written statement declaring that the money for the purchase of land is, in whole or in part, the common good of the couple: the request for acquisition of land filed by The Thai national is subject to the decision of the Minister of the Interior.

2 – Case of a Thai national living in concubinage with a (an) international (e)

If he wishes to buy land or receive title to a third party to convey to this Thai national, legally has the right, provided that after investigation the authorities, both cohabitants make a written jointly as What money the Thai national reserve for the purchase of the land comes in whole and exclusively, his own personal funds and not part of the joint property of the couple.

If the foreign partner would not ratify such written statement or written statement declaring that the money for the purchase of land is, in whole or in part, the common good of the couple: the request for acquisition of land filed by The Thai national is subject to the decision of the Minister of the Interior.

3 – Case of a Thai national divorced (e) or separated (e) with (e) Foreign (e)

the Thai national has the right to ownership of land, if they wish, provided that after investigation the authorities, it appears that this is not a maneuver to avoid the law.

4 – The case of a child of a (an) international (e) having Thai nationality.

If he pleads his right to have ownership of land, it has this right, provided that after investigation by authorities, it appears that this is not an attempt to to circumvent the law.
